DECISION AND REASONS
1. Having heard from the parties and by consent, in relation to the decision of the Court of Appeal dated 27 November 2012 and the order made by consent, it is accepted that the appeal is allowed and the determination of the First-tier Tribunal promulgated on 15 August 2010 be restored. It is further agreed that there is no appeal by either party pending in the Upper Tribunal notwithstanding the reference in the recital in the order of the Court of Appeal otherwise.
