DECISION AND REASONS
1. On 16 December 2016 at Manchester Civil Justice Centre the decision of the First-tier Tribunal was set aside due to a material error of law having been found and directions given for the future conduct of this case, which read:
i. The dismissal of the protection claims shall be a preserved finding.
ii. The direction for the respondent to reconsider the section 55 element of the appeal properly and direction for the matter to be remitted for this purpose shall be a preserved finding.
iii. Determination of the appellants Article 8 ground of appeal shall be adjourned pending the outcome of the reconsideration process, to stand dismissed if a fresh decision is made giving rise to a further right of appeal or if certified and open top challenge by way of judicial review, or, in any event, by 4.00pm 1 April 2017 unless either party seeks further directions from the Tribunal for the adjournment to continue.
2. There has been no further communication received from either party and, accordingly, the appellants Article 8 appeal is dismissed.
