Notice of Withdrawal

1. The First-tier Tribunal allowed the appeal of Ms Paca under Article 8 ECHR in a determination dated 11 July 2017.
2. The Secretary of State for the Home Department applied for permission to appeal the decision and permission was granted on 26 July 2017.
3. In a letter dated 5 October 2017 the respondent gives notice of withdrawal of her case before the Upper Tribunal. She concedes that Ms Paca qualifies for leave under Article 8 ECHR in line with her own published guidance.
4. The Tribunal consents to the withdrawal.
5. The decision of the First-tier Tribunal stands and Ms Paca's appeal is allowed under Article 8 ECHR.
