NOTICE OF ABANDONMENT

1. The SSHD appealed against a determination by First-tier Tribunal Judge Fox, promulgated on 26 March 2014, allowing the appeal by Mr Zhengtao Cai (a citizen of China, born on 30 July 1995) against refusal of his application as a student under the Points Based System (PBS).

2. Mr Matthews advised that the appellant has left the UK, voluntarily, but in compliance with removal directions made by the SSHD at his request.

3. Under reference to section 104(4) of the Nationality, Immigration & Asylum Act 2002 and to Rule 17A of the Tribunal Procedure (Upper Tribunal) Rules 2008 the appeal is treated as abandoned.
