UPON the respondent having reviewed her decision and confirming that her decision to refuse the appellant refugee status is no longer sustainable in the light of the current country situation in Afghanistan
AND UPON Ms Everett, on behalf of the respondent confirming that the respondent wishes to withdraw her case
AND UPON Ms Everett confirming that the appellant will be granted refugee status within 28 days unless special circumstances prevent this
AND UPON the Upper Tribunal consenting to the SSHD's withdrawal of its case pursuant to rule 17(2) of the Tribunal Procedure (Upper Tribunal) Rules 2008

BY CONSENT IT IS ORDERED THAT
1. The Upper Tribunal consents to the respondent withdrawing her case.
2. The decision of the First-tier Tribunal contains an error of law and is set aside.
3. The appellant's appeal is allowed on international protection and human rights grounds.
