DECISION AND REASONS
1. On 12 April 2023 I wrote to the parties as follows:
“I have reviewed the file in this case, including the Secretary of State’s response to the grant of permission. It appears to me that the error of law identified in the grant of permission is more than arguable, and I propose without more ado to set aside the decision of the First-tier Tribunal for error of law and remit the appeal for a new decision in the First-tier Tribunal.
Any submissions to the contrary will be considered if received within 21 days of the date of this letter.”
2. Both parties have indicated that they are content for me to proceed as proposed. I now set aside the decision of the First-tier Tribunal for error of law and remit the appeal for a fresh decision by the First-tier Tribunal.
