DECISION AND REASONS
1. In a skeleton argument dated 24 November 2023, the respondent conceded that the decision of FtT Judge Prudham, dismissing the appellant’s appeal, errs in law, and that the appellant’s application to the respondent met the requirements of the EU Settlement Scheme, EU11.
2. In light of that concession, the hearing which was due to take place on 1 December 2023 was vacated. It has come to attention, however, that no decision has been issued. It may be that parties have regulated the practical outcome between themselves; but to dispose of the appeal, this decision is now made.
3. The decision of the FtT is set aside. The appeal, as originally brought to the FtT, is allowed.
