DECISION
1. This notice of decision is given pursuant to rule 40(3)(a) of the Tribunal’s Procedure Rules.
2. The Secretary of State appeals, with permission, against the decision of the First-tier Tribunal (Judge Athwal) allowing the appeals of Faizan Ahmed and four family members against her decisions refusing family permits under Appendix EU of the Immigration Rules.
3. We heard submissions from Mr Mullen and Mr Halliday. This is a case in which there was an unusual conjunction of facts and dates relating to the making of the respondents’ original applications. Mr Mullen, on behalf of the Secretary of State, was able to give full consideration to his grounds in the light of Mr Halliday’s explanation of the facts.
4. By consent, the Secretary of State’s appeal is dismissed.
