DECISION AND REASONS

1. In the FtT, Judge Thapar dismissed this appeal, and Judge Singer granted permission to appeal to the UT. In response, the SSHD correctly concedes that the FtT failed to treat the appellant as a vulnerable witness in line with Presidential Guidance.

2. The decision of the FtT is set aside. It stands only as a record of what took place at the hearing. The case is remitted to the FtT for fresh hearing, not before Judge Thapar.

3. Pursuant to rule 14 of the Tribunal Procedure (Upper Tribunal) Rules 2008, the appellant is granted anonymity.

4. No-one shall publish or reveal any information, including the name or address of the appellant, likely to lead members of the public to identify her. Failure to comply with this order could amount to a contempt of court.
