UPON hearing from Mr Aziz for the Appellant and Mr Tan for the Respondent
UPON Mr Tan on behalf of the Respondent accepting the claim made by the Appellant in his grounds of appeal and as confirmed by his solicitors that the notice of the FTT hearing was not received by the Appellant
AND UPON both parties agreeing that in the circumstances, the FTT acted procedurally unfairly in proceeding with the hearing in the Appellant’s absence, such that the FTT decision should be set aside and the appeal remitted to the FTT
IT IS ORDERED:
(1) The appeal against the FTT’s decision is allowed and set aside.
(2) The appeal is remitted to the FTT.
