Pursuant to rule 14 of the Tribunal Procedure (Upper Tribunal) Rules 2008, the appellant is granted anonymity.

No-one shall publish or reveal any information, including the name or address of the appellant, likely to lead members of the public to identify the appellant. Failure to comply with this order could amount to a contempt of court.


ORDER FOR REMITTAL
1. Further to the decision of myself and Mr Justice Lavender, allowing the Appellant’s appeal and setting the decision of the First-tier Tribunal aside, with no findings preserved, the Appellant has made further submissions on disposal.
2. Having considered those submissions the Tribunal accepts that in this instance the most appropriate forum for remaking would be the First-tier Tribunal. Although the Appellant has now had his case considered by the First-tier Tribunal on three occasions, we are mindful that these decisions did not all relate to this appeal. On this occasion the only decision by the First-tier Tribunal is the one we have set aside, in its entirety, necessitating extensive findings of fact. For that reason, we agree to remit the matter so that the decision in the appeal can be re-determined by a Judge of the First-tier Tribunal.
