DECISION AND REASONS
MADE WITHOUT A HEARING PURSUANT TO
RULE 34 OF THE TRIBUNAL PROCEDURE (UPPER TRIBUNAL) RULES 2008


1. The Appellant appeals against the decision of First-tier Tribunal Judge Caskie (the “Judge”) dated 6 January 2026 (“the Decision”) dismissing the Appellant’s protection based appeal.

2. The Appellant’s grounds of challenge to the Decision include an assertion that the Judge gave an oral decision at the hearing that he would allow the appeal but subsequently dismissed the appeal on all grounds in his written reasons.

3. Permission to appeal was granted by FtTJ Turner on 10 June 2026 in the following terms:

The grounds assert that the Judge erred in giving an oral judgement at the conclusion of the appeal hearing to the effect that the appeal was to be allowed and then issuing inconsistent written reasons in which the appeal was dismissed on all grounds. A transcript of the IJs remarks at the conclusion of the hearing have been provided in support of this application.

3. In line with PAA (FtT: Oral decision – written reasons) Iraq [2019] UKUT 13 (IAC) the Appellant has identified an arguable error of law.

4. By a Rule 24 response dated 2 July 2026 the Respondent has indicated that she does not oppose the Appellant’s appeal on the basis of procedural fairness. In accordance with the Respondent’s concession, I therefore find there to be an error of law in the Decision. I set the Decision aside in its entirety and remit the appeal to the First-tier Tribunal for re-hearing before any judge other than Judge Caskie.


NOTICE OF DECISION
The Decision of Judge Caskie promulgated on 29 January 2026 involved the making of an error of law. I therefore set aside the Decision in its entirety. I remit the appeal to the First-tier Tribunal for re-hearing before any judge other than Judge Caskie.
