DECISION AND REASONS

1. This is an appeal against a decision of Judge of the First-tier Tribunal Persaud (“the judge”) dated 9 June 2026.

2. On 12 August 2026 permission to appeal was granted by the First-tier Tribunal.

3. On 27 August 2026 the respondent filed a response to the grounds of appeal pursuant to rule 24. In the response, the respondent states that she accepts that the judge erred and proposes that the appeal should be remitted to the First-tier Tribunal.

4. As the parties appear to be in agreement, I have decided, pursuant to rule 34, to make a decision without a hearing; and, in accordance with the positions of the parties, have decided to set aside the decision of the First-tier Tribunal and remit the appeal to the First-tier Tribunal to be made afresh.

5. As I have made this decision without a hearing, I have included a direction to enable the parties to raise any objections. However, no response is required and in default the decision will be set aside and the appeal will be remitted to the First-tier Tribunal.

6. The decision of the First-tier Tribunal is set aside with no findings preserved and the appeal is remitted to the First-tier Tribunal for the decision to be made afresh by a different judge.

7. Any party that disagrees with the order in paragraph 6 must file and serve written submissions, giving their reasons, within 7 days of this decision being sent. If no written submissions are received within 7 days the order in paragraph 6 will take effect.
