The Secretary of State concedes that as at 7 January 2009 for the purpose of International Humanitarian Law (IHL) there is an internal armed conflict in Afghanistan extending to the whole of the territory of Afghanistan
DIRECTIONS
The respondent having by letter dated 7 January 2009 conceded that, for the purposes of International Humanitarian Law (“IHL”) there is at present an internal armed conflict in Afghanistan, and that for the purposes of IHL the whole of the territory of Afghanistan is to be treated as being in such a conflict
IT IS DIRECTED that the issue as to the existence of such a conflict is not to be aired at the forthcoming substantive hearing.
